Terms of Service

MyAIConsent ("the Platform") is operated by Krupesh Desai, an independent software developer based in Melbourne, Australia. References to "I", "me", and "my" in these terms refer to Krupesh Desai as the sole operator of MyAIConsent at myaiconsent.app.

These Terms of Service govern your access to and use of myaiconsent.app. By creating an account or using the Platform, you agree to these terms. If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 18 years old to use the Platform. By using MyAIConsent, you confirm that you are 18 or older and able to enter into a binding agreement.

2. The Service

MyAIConsent lets you create AI Twins: chatbots trained on content you upload, using Retrieval-Augmented Generation (RAG). Your AI Twins can answer questions based on your content, capture leads, and be embedded on your own website or shared via a public link. The Platform is provided on an ongoing basis and I may add, change, or remove features over time.

3. Your Account

You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Please notify me promptly at support@myaiconsent.app if you believe your account has been compromised.

4. Subscriptions and Billing

AI Twins are offered on a paid subscription basis, billed per twin on a monthly cycle. Pricing depends on the AI model you select when creating a twin. Payments are processed securely by Stripe. I never store your card details on my servers. By subscribing, you authorise the recurring monthly charge for each twin until you cancel.

5. Cancellation and Refunds

You can cancel any twin's subscription at any time from your account dashboard. When you cancel, your twin remains active until the end of your current paid billing period, and you will not be charged again after that. Subscriptions are non-refundable, including for partial billing periods. You keep access to what you have already paid for until the period ends.

6. Your Content and Ownership

You retain full ownership of the content you upload. By uploading content, you grant me a limited licence to process and store it solely for the purpose of operating your AI Twins (including processing it through RAG and generating responses). I do not use your content to train third-party AI models, and I do not share it with other users or organisations unless you explicitly make a twin public. You are responsible for ensuring you have the right to upload and use the content you provide. For details on how I handle your data, see my Privacy Policy.

7. Acceptable Use

You agree not to use the Platform to upload, generate, or distribute content that is illegal, harmful, infringing, deceptive, or abusive. You agree not to attempt to disrupt, reverse engineer, overload, or gain unauthorised access to the Platform or its systems, and not to use the Platform to harass others or violate their rights. I may suspend or remove content or accounts that breach these terms.

8. My Intellectual Property

The Platform itself, including its software, design, branding, and underlying technology, is my property. These terms do not grant you any right to my intellectual property beyond the limited right to use the Platform as intended.

9. Service Availability

I work to keep the Platform available and reliable, but it is provided "as is" and "as available". I do not guarantee uninterrupted or error-free service, and I may modify, suspend, or discontinue features at any time. Scheduled maintenance or unforeseen issues may occasionally affect availability.

10. AI Output Disclaimer

AI Twins generate responses based on the content you provide and may not always be accurate or complete. You are responsible for how you configure and use your AI Twins and for any reliance placed on their output. The Platform does not provide professional advice (including legal, medical, or financial advice), and AI responses should not be treated as such.

11. Limitation of Liability

To the maximum extent permitted by law, I am not liable for any indirect, incidental, or consequential losses arising from your use of the Platform. My total liability for any claim relating to the Platform is limited to the amount you paid me in the three months preceding the claim. Nothing in these terms excludes rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

12. Termination

You may stop using the Platform and delete your account at any time. I may suspend or terminate your access if you breach these terms or use the Platform in a way that risks harm to others or to the Platform. On termination, your right to use the Platform ends, and your data is handled in line with my Privacy Policy.

13. Changes to These Terms

I may update these Terms of Service from time to time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria, Australia.
